Speedy split decision

Who says the wheels of justice always move slowly?

Just nine days after oral arguments, the Supreme Court affirmed a lower court decision allowing parents to get reimbursement from a public school district for private school tuition costs under the Individuals with Disabilities Education Act, even though their children never attended public school.

The Court was split 4-4, and affirmed the lower court decision in this very short order in the case of New York City Board of Education v. Tom F. Justice Anthony Kennedy recused himself from the case and took no part. (More on the case here.)
